The BORKOW application and the website https://experientialtravelers.com (together, the “Services”) constitute a private digital ecosystem combining community features, experiential travel content, social interactions, and premium functionalities.

BORKOW reserves the right to evolve the nature, positioning, features, algorithms, access conditions, and business model of the Services at any time, without obligation of continuity or backward compatibility.

The Services are provided on a best-effort basis and do not constitute a dating service, travel agency, tour operator, or professional matchmaking service.

2. Acceptance of the Terms

By creating an account, accessing, or using the Services, the user expressly and irrevocably accepts these Terms of Service in their entirety, including any future updates.

Continued use of the Services after modification of the Terms constitutes full and unconditional acceptance of the revised Terms.

If the user does not accept these Terms, they must immediately stop using the Services and delete their account.

To access certain features, users must create an account and provide accurate, complete, and up-to-date information.

BORKOW reserves the right to suspend or permanently delete accounts in case of breach of these Terms, without prior notice or compensation.

5. User Obligations

Users expressly agree to:

– Respect other users and the community spirit of BORKOW

– Not engage in harassment, spam, solicitation, scraping, reverse engineering, or automated access

– Not misuse matching, messaging, groups, or visibility mechanisms

– Not create multiple accounts, impersonate others, or provide false information

– Not attempt to bypass paywalls, limits, algorithms, or security measures

– Not upload or share content that is illegal, defamatory, obscene, threatening, or that infringes third-party rights

BORKOW applies a zero-tolerance policy regarding abuse, fraud, manipulation, or harmful behavior. BORKOW may suspend, restrict, shadow-ban, limit visibility, or permanently delete any account without prior notice or compensation, at its sole discretion, in order to protect the integrity of the platform.

6. User-Generated Content & Content License

Users are solely responsible for all content they publish, upload, transmit, or make available through the Services, including but not limited to text, photos, videos, comments, travel logs, itineraries, and profile information (collectively, 201cUser Content201d).

By submitting User Content on the Services, the user grants BORKOW a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, display, distribute, adapt, and translate that content solely for the purposes of operating, improving, and promoting the Services. This license ends when the user deletes their content or account, subject to any technical delays inherent to the platform.

The user warrants that they hold all necessary rights to grant the above license and that their User Content does not infringe any third-party intellectual property rights, privacy rights, or applicable law.

BORKOW has no obligation to monitor content but reserves the absolute right to:

– Moderate, remove, alter, or restrict any User Content

– Disable interactions or visibility of any account or content

– Cooperate with law enforcement or judicial authorities if required

BORKOW acts as a technical intermediary and hosting provider. In accordance with applicable law, BORKOW cannot be held liable for User Content but reserves the right to moderate or remove content at its sole discretion.

7. Intellectual Property

All content, trademarks, logos, designs, texts, interfaces, and software related to BORKOW are the exclusive property of BORKOW and are protected by applicable intellectual property laws.

Any reproduction, representation, adaptation, or exploitation, in whole or in part, without the prior written consent of BORKOW, is strictly prohibited and may constitute an infringement punishable under law.

The license granted to BORKOW under Article 6 does not affect the user's ownership of their original content.

8. Paid Subscriptions

Certain features of the Services are accessible through paid subscriptions.

– Prices are displayed in the applicable currency and may change at any time with advance notice

– Subscriptions may be monthly, annual, promotional, or lifetime offers

– Billing, renewals, and cancellations are managed by third-party platforms (Apple App Store, Google Play Store, Stripe, etc.) and are governed by their respective terms

– No refunds, credits, or compensation shall be granted for partial use, inactivity, suspension, or termination of an account, except where mandatory under applicable law

BORKOW reserves the right to modify pricing, features, or access levels at any time. In the event of a material change to a paid subscription, BORKOW will provide reasonable advance notice.

9. Availability and Modification of Services

BORKOW strives to ensure the availability of the Services but does not guarantee uninterrupted or error-free access.

The Services may be temporarily or permanently modified, suspended, restricted, or discontinued, in whole or in part, without liability to BORKOW, including for reasons of maintenance, security, legal compliance, or business decisions.

10. Liability Limitation

The Services are provided "as is" and "as available", without warranty of any kind, express or implied.

To the maximum extent permitted by applicable law, BORKOW shall not be liable for:

– Any direct, indirect, incidental, consequential, or punitive damage resulting from use or inability to use the Services

– User interactions, meetings, disputes, or real-world consequences arising from use of the platform

– Loss of data, reputation, opportunity, income, or profits

– Decisions made based on content, recommendations, or interactions within the Services

– Unauthorized access to or alteration of user transmissions or data

Users acknowledge that all interactions — online and offline — occur at their own risk. BORKOW is not responsible for the behavior, intentions, or actions of any user.

11. Termination

Users may delete their account at any time via the settings of the application or by contacting BORKOW through the contact page at https://experientialtravelers.com/contact.

BORKOW may, at its sole discretion, suspend, restrict, or permanently terminate any account or access to the Services, without prior notice or compensation, in case of suspected breach, abuse, fraudulent activity, or risk to the platform or its users.

Upon termination, the user's license to use the Services immediately ceases. BORKOW may retain certain data as required by applicable law or legitimate business purposes, in accordance with the Privacy Policy.

12. Personal Data & GDPR

BORKOW, acting as data controller, collects and processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Belgian data protection law.

The data collected includes, but is not limited to: name, email address, approximate location, profile photos, travel content, and technical usage data (device identifiers, crash logs).

Data is collected for the purposes of providing the Services, personalizing the user experience, ensuring security, and improving the platform. Data is not sold to third parties.

13. Modifications to These Terms

BORKOW reserves the right to modify these Terms of Service at any time. In the event of a material change, BORKOW will notify users by one or more of the following means:

The updated Terms will indicate the new "Last Updated" date at the top of the page. If the user continues to use the Services after the effective date of the changes, they will be deemed to have accepted the revised Terms.

If the user does not accept the modified Terms, they must stop using the Services and delete their account before the effective date of the changes.

14. Governing Law & Dispute Resolution

These Terms of Service are governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions.

In the event of any dispute, controversy, or claim arising out of or in connection with these Terms or the Services, the parties agree to first attempt resolution through good-faith negotiation.

In the absence of an amicable resolution within 30 days, any dispute shall be submitted to the exclusive jurisdiction of the courts of Brussels, Belgium.
